This agreement ("Agreement") describes the terms and conditions applicable to your use of the CelebFanMail Web site (the "Site"), which is a trading name of X-Line Ltd. By using the Site you, ("You"), accept the terms and conditions of this Agreement and agree to be bound by them. We may amend this Agreement at any time by posting the amended terms on the Site, and all amendments shall supercede this Agreement and be effective regarding your use of the Site immediately upon posting.
The Site provides access to an online database of fan mail addresses. The Site is in no way related to or in partnership with any of the individuals or organisations listed in our database. The addresses on this database were compiled through a variety of online and offline sources. We do not guarantee and accept no liability for the reliability or accuracy of any of the addresses listed.
By use of our site you agree to indemnify and hold CelebFanMail.com, its parents, subsidiaries, affiliates, officers and employees, harmless from any claim, demand, or damage, including reasonable attorneys' fees, asserted by any third party due to or arising out of your use of or conduct of our site. In no event will CelebFanMail.com and/or X-Line Limited be liable for any damages including, without limitation, indirect or consequential damages, or any damages whatsoever arising from use or loss of use, data, or profits, whether in action of contract, negligence or other tortious action, arising out of or in connection with the use of the site.
You also are responsible for any charges incurred to access CelebFanMail, such as telephone and other equipment charges, and fees charged by an Internet access provider or other third party service. You are also responsible for any applicable taxes relating to your use of the services.
CelebFanMail will make every effort to keep its services available 24 (twenty four) hours a day, seven (7) days a week and to maintain saved information. However, due to technical failures, acts of God or routine maintenance, availability may be limited and/or information may be lost. CelebFanMail shall not be liable for lost information or non-availability of the services.
Refunds will be issued within seven (7) days of your first membership payment providing you contact us within this time period. Refunds will result in your membership being terminated immediately and all outstanding days left will be forfeited.
Except as to payment obligations, neither party shall be liable or considered in default under this Agreement when the delay of performance is caused by circumstances beyond its reasonable control and occurring without its fault or negligence, including failure of suppliers, licensors, subcontractors, and carriers, acts of civil or military authorities, national emergencies, fire, flood, acts of God, insurrection, and war, provided the party involving this Section immediately provides notice thereof to the other and does everything reasonably possible to resume its performance there under.
The free request-an-address service is limited to a maximum of 10 requests per month. This is to prevent abuse of the system and to allocate fair resources to each user. The request-an-address service is a free service to all paying, active members. We can not guarantee that an address will be found or if it will be reliable.
Your subscription will continue until terminated by CelebFanMail or until you notify CelebFanMail by telephone, electronic mail, or via means provided within the service of your decision to terminate your subscription. CelebFanMail may discontinue or change its services, or its availability to you, at any time, and you may always terminate your subscription at any time. This Agreement is personal to you, and you may not assign your rights or obligations to anyone. If you elect to cancel your subscription, the cancellation will be effective on your next monthly subscription anniversary date. The monthly subscription anniversary date is the day-of-the-month on which you subscribed to the service.
If any of these Terms and Conditions should be determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these Terms and Conditions are intended to be effective, then to the extent and within the jurisdiction which that Term or Condition is illegal, invalid or unenforceable, it shall be severed and deleted from this clause and the remaining terms and conditions shall survive, remain in full force and effect and continue to be binding and enforceable.
These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. Disputes arising here from shall be exclusively subject to the jurisdiction of the courts of England and Wales. If these Terms and Conditions are not accepted in full, you do not have permission to access the contents of this website and therefore should cease using this website immediately. CelebFanMail in its sole discretion, terminate or suspend your access to all or part of the Service for any reason, including, without limitation, breach or assignment of this Agreement. Use or sharing of passwords by non-subscribers is prohibited. Failure to comply will result in immediate suspension of your account.
